1.5. Modification and Termination: Mindful Kids London reserves the right to modify or terminate this course at any time without notice. Mindful Kids London may also terminate your access to this course at any time without notice and without liability.

1.6. No Warranty: This course is provided "as is" without warranty of any kind, whether express or implied. Mindful Kids London does not guarantee that the course will be error-free or uninterrupted, or that any defects will be corrected.

Payment and Refunds

2.1. Payment: The Teaching mindfulness in nature to children course requires payment of a fee to access the course materials. Payment must be made through the payment methods made available by Mindful Kids London.

2.2. Refunds: Refunds for the course fee will only be issued in the event of a technical error on the part of Mindful Kids London or if the course is cancelled by Mindful Kids London. Refunds will not be issued for any other reason.

Intellectual Property Rights

3.1. Ownership: The Teaching mindfulness in nature to children course and all content, graphics, images, and other materials provided by Mindful Kids London are owned by Mindful Kids London and are protected by copyright, trademark, and other intellectual property laws.

3.2. Restrictions: You may not modify, reproduce, distribute, display, or create derivative works of any materials provided in the course without the prior written consent of Mindful Kids London.

Limitation of Liability
4.1. Liability: Mindful Kids London shall not be liable to you or any third party for any damages whatsoever, including but not limited to direct, indirect, special, punitive, or consequential damages, arising out of or in connection with your use or inability to use the Teaching mindfulness in nature to children course, whether based on contract, tort, strict liability, or any other legal theory, even if Mindful Kids London has been advised of the possibility of such damages.

4.2. Indemnification: You agree to indemnify and hold harmless Mindful Kids London, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the course or any breach of these Terms of Use Agreement.

4.3. Limitations: In no event shall Mindful Kids London's total liability to you for all damages, losses, and causes of action, whether in contract, tort (including negligence), or otherwise, exceed the amount paid by you, if any, for access to the course. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

4.4. Force Majeure: Mindful Kids London shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond its reasonable control, including but not limited to, mechanical, electronic, or communications failure or degradation.

Governing Law and Dispute Resolution

5.1. Governing Law: This Terms of Use Agreement shall be governed by and construed in accordance with the laws of England and Wales.

5.2. Dispute Resolution: Any dispute arising out of or in connection with this Terms of Use Agreement shall be referred to and finally resolved by arbitration under the rules of the London Court of International Arbitration, which rules are deemed to be incorporated by reference into this clause.

Miscellaneous

6.1. Entire Agreement: This Terms of Use Agreement constitutes the entire agreement between you and Mindful Kids London with respect to the Teaching mindfulness in nature to children course and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Mindful Kids London.

6.2. Severability: If any provision of this Terms of Use Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

6.3. Waiver: The failure of Mindful Kids London to enforce any right or provision of this Terms of Use Agreement shall not constitute a waiver of such right or provision.

By accessing or using the Teaching mindfulness in nature to children course, you acknowledge that you have read, understand, and agree to be bound by this Terms of Use Agreement. If you do not agree to these terms, you should not access or use the course.
